The Code of Student Conduct (CSC) identifies and defines non-academic behaviour that is not permitted on University of Toronto premises or during any University-sponsored activity.
Complaints of violations of the CSC are referred to the head of the division in which the accused is registered. The division head decides if there is sufficient evidence of misconduct to warrant an investigation of the incident. The investigation is conducted by the divisional Investigating Officer (IO), at the end of which a report is submitted to the divisional head. On the basis of that report, the division head may or may not choose to lay charges.
If charges are laid, the division head requests that the divisional Hearing Officer (HO) conduct a hearing into the matter. The parties to the hearing are the division head and the accused student.
Normally the IO presents the case on behalf of the division head. Both parties are permitted to retain legal representation and to call witness in support of their respective arguments. Following the hearing, the HO will issue a decision and, if the HO decides that the accused student has committed the offence, also impose a sanction.
The Hearing Officer’s decision may be appealed to the Discipline Appeals Board.
